On July 14, 2021, the Environment and Land Court suspended the construction of the Safaricom staff pension, a housing project in Athi River, Machakos County.
The court ordered the project be suspended until an application filed by Mavoko Water and Sewerage Company over interference with its sewer line is heard on July 27, of that year.
Mavasco filed a petition against Safaricom Pension Trustees Project and Pristine Contractors Limited on allegations the ongoing construction, at the time, was interfering with the company’s sewerage system and was likely to affect thousands of residents.
The case was filed before Justice Angote on July 14, 2021. The order was also issued on July 14.
In this case, Safaricom Staff Pension Scheme Registered Trustees and Pristine Contractors Limited have been listed as first and second respondents.
“A temporary injunction be and is hereby issued restraining the defendant either by itself, agents, servants, employees and or proxies from excavating, laying foundation, constructing, cementing, culverting, or building any structure atop the plaintiff sewer line,” the order indicates.
Safaricom won the case! Fast forward, to 2024 the estate is FLOODED. No drainage.
